Tenant unions are organized groups of renters who work together to address shared housing problems — unsafe conditions, rent increases, eviction threats, or landlord communication issues. They may be building-based, citywide, or tied to a larger tenant organization.

Tenant unions are organized groups of renters who work together to address shared housing problems — unsafe conditions, rent increases, eviction threats, or landlord communication issues. They may be building-based, citywide, or tied to a larger tenant organization.

What they do in practice

Tenant unions typically coordinate meetings, document complaints, negotiate collectively, and connect tenants with legal help. Some also organize public-pressure tactics or rent strikes when they feel issues aren't being resolved through normal channels.

The case for and against

Tenant unions are one of the more polarizing topics in rental housing. The arguments on each side are worth understanding clearly:

Supporters Argue

Critics Argue

They help balance the power gap between tenants and landlords.

They can escalate conflict that might otherwise be resolved one-on-one.

They can drive repairs and improved habitability conditions.

They complicate day-to-day property management.

They can lead to policy changes and stronger tenant protections.

When tied to broader rent-control efforts, they may contribute to housing-supply concerns.

📍

Bay Area tenant groups have played visible roles in organizing around rent debt, habitability complaints, and local housing policy — including efforts that have shaped ordinances at the city and county level.

 ━━ Key Takeaways

What you'll learn in this article

Geopolitical shocks abroad can quickly translate into higher mortgage rates and material costs at home.

Builder sentiment hit a seven-month low in April, with 62% reporting higher material costs and 70% struggling to price homes.

Mortgage rates climbed from 5.98% to 6.37% between late February and early April amid rising inflation fears.

Bay Area investors should tighten rehab assumptions, watch rates closely, and pay attention to systems-heavy repairs in older buildings.

It's not just war headlines overseas. It's the way energy shocks can move through the U.S. economy and show up in real estate through higher mortgage rates, rising material costs, and builder activity.

Reuters reported on April 15 that U.S. import prices could face sharper increases as the Iran conflict pushes oil prices higher and disrupts supply chains. For real estate owners, that matters because fuel is built into almost everything: transportation, delivery, manufacturing, contractor pricing, and job-site logistics. Even if a property owner is only replacing a water heater, patching a roof, or repairing plumbing, higher freight and energy costs can still work their way into the final invoice.

Builder sentiment hits a seven-month low

That same day, Reuters also reported that home builder sentiment fell to a seven-month low in April. According to the cited survey, 62% of builders reported higher material costs due to fuel prices, and 70% said pricing homes had become more difficult. Reuters also noted that mortgage rates had climbed from 5.98% in late February to 6.37% in early April amid rising inflation fears.

That is an important signal for investors, even if they are not homebuilders themselves.

"Even distant geopolitical shocks can show up quickly in U.S. real estate — not always through dramatic headlines, but through the quieter pressure points that matter most to investors."

When builders face cost and financing pressures, some projects slow down, get repriced, or become less feasible. Over time, that can reduce the supply of new housing. In theory, a tighter supply can support rents and property values in some markets. But the near-term effects are often messier: higher borrowing costs, fewer transactions, and greater uncertainty around construction and renovation budgets.

Reuters followed up on April 20 by reporting that U.S. homebuilders are bracing for another difficult year as the Iran war and tariffs squeeze margins. The article pointed to pressure on pipe, freight, and infrastructure-related costs. That matters far beyond subdivision developers. Many of the same inflationary pressures can hit apartment owners, small multifamily operators, and value-add investors trying to renovate older units. If pipe, freight, or equipment costs rise again, a project that penciled out 60 days ago may not pencil out the same way today.

What this means for Bay Area investors

For small-to-mid-sized investors in the Bay Area, there are a few practical takeaways.

1. Tighten your rehab and CapEx assumptions

This is a reminder to tighten your rehab and capital-expenditure assumptions. If you're underwriting a unit turn, exterior repairs, or a larger repositioning project, leave more room for volatility in materials and contractor bids.

2. Watch rates closely

Even if you are not refinancing this month, mortgage-rate pressure tends to ripple through the market. It affects buyer demand, seller expectations, cap-rate conversations, and overall deal velocity.

3. Pay attention to systems-heavy repairs

Investors with older properties should pay special attention to systems-heavy repairs. Projects involving plumbing, roofing, mechanical equipment, or other material-intensive work may be more exposed if oil and shipping-related costs remain elevated.

⚠️

 Heads Up

A renovation project that penciled out 60 days ago may not pencil out today. Rebid contractor estimates and reconfirm material pricing before locking in scope on any project that's still in the planning stage.

Where the pressure shows up

Here's how energy and supply-chain shocks tend to translate into different parts of a small investor's portfolio:

Area

Direct Impact

What to Do

Mortgage rates

Up nearly 40 bps in six weeks

Stress-test deals at higher rate scenarios

Material costs

62% of builders report increases

Get fresh contractor bids; pad budgets 10-15%

Plumbing & pipe work

Heavily exposed to freight costs

Prioritize and lock pricing on planned work

The bottom line

The headline from these Reuters reports is simple: even distant geopolitical shocks can show up quickly in U.S. real estate. Not always through dramatic headlines, but through the quieter pressure points that matter most to investors — rates, repairs, project costs, and margins.

For Bay Area landlords and small multifamily operators, the right response isn't panic. It's discipline: tighter underwriting, more cushion in rehab budgets, and a closer eye on the rate environment when you're sizing up your next deal.

 ━━ Key Takeaways

What you'll learn in this article

Mountain View's City Council voted 5–1 on February 10, 2026 to scrap unit-per-acre caps across roughly half the city; the ordinance is targeted to take effect late spring 2026.

The new rules shift to form-based standards — height, footprint, and street fit — making traditional apartment buildings financially viable again on key corridors.

Capacity for 10,000–16,000 additional homes is concentrated in about 15 targeted growth areas, led by the California Street corridor at up to 110 units per acre.

A companion rule still being drafted may require below-market-rate replacement units when redeveloping rent-controlled buildings — a major unknown for project economics.

Not every R3 parcel benefits — some properties wedged near single-family streets may face stricter setbacks under the new rules than they had before.

Mountain View's apartment zoning just got its biggest shakeup in decades. On February 10, 2026, the City Council voted 5–1 to rewrite the rules that govern how — and how densely — you can build across roughly half the city. The ordinance isn't signed yet; late spring 2026 is the current target. But the Council has made its direction clear, and for anyone with skin in the local multifamily market, it's worth paying close attention.

What's actually changing

For decades, Mountain View's zoning rules for apartment buildings produced one thing above almost everything else: rowhouses. The old system capped units per acre so tightly that building a traditional apartment block simply didn't pencil for most developers.

The new system throws out those unit caps and instead focuses on how a building looks and fits its surroundings — its height, its footprint, how it meets the street. The practical effect: significantly larger and taller apartment buildings will be allowed in key parts of the city, particularly along major roads and near transit.

The city estimates the update could unlock capacity for 10,000 to 16,000 additional homes citywide over time.
 — City of Mountain View planning estimates

Where the opportunity is greatest

Not every block benefits equally. The biggest density increases are concentrated in about 15 specific areas the Council has targeted for growth. Based on the current planning direction, these are the corridors with the strongest redevelopment potential:

Corridor

Why It Stands Out

California Street corridor

The only area in the city where up to 110 units per acre are allowed as a starting point.

Del Medio South / San Antonio Road

Close to Caltrain and the San Antonio shopping center, with larger parcels suited to bigger apartment projects.

Continental / Dale area

Near the Sunnyvale border, with existing large complexes and freeway adjacency that makes height less of a neighborhood concern.

Rengstorff Avenue

Already seeing active developer interest, with several large projects in the pipeline even before the new rules take effect.

Moffett Boulevard

Benefits from both the new apartment zoning and a separate program converting nearby lower-density land to allow apartments for the first time.

The catch investors need to know about

There is one major unknown that could significantly affect the math on any redevelopment project: a new local rule currently being written alongside the zoning update.

⚠️

 Heads Up

If you demolish an existing rent-controlled apartment building to redevelop the site, you may be required to include an equivalent number of below-market-rate units in your new building. The city hasn't finalized this rule yet — but it could materially change the financial picture on any rent-controlled parcel you're considering.

Also worth noting: not all R3 properties benefit from the changes. Parcels squeezed between apartment zones and single-family streets may actually end up with stricter rules than before — particularly a new 20-foot front setback requirement that critics say limits how much of the lot can actually be built on.

⚖️

 Legal Note

Always confirm which new zoning category your specific parcel falls into before making any decisions. The ordinance language is still being finalized, and proximity to single-family streets, transit, or specific overlays can produce very different results on adjacent lots. Consult the city's zoning maps and an attorney familiar with Mountain View land use before relying on any preliminary read.

The bottom line

This is the largest restructuring of Mountain View's apartment rules in a generation, and it's set to reward owners along specific corridors while leaving other R3 parcels with less flexibility, not more. The corridor your property sits on — and how the still-pending rent-controlled replacement rule lands — will determine whether your lot becomes a meaningfully more valuable redevelopment site or stays roughly where it is.

If you own property in one of the high-growth corridors, now is the time to understand exactly where your parcel lands under the new framework.

What you'll learn in this article

Smith v. City of Oakland argues that Oakland's Rent Adjustment Program effectively excludes tenants with mobility disabilities because accessible units tend to be newer, and newer means exempt.

In an August 2025 order, the federal court found the tenants had presented enough evidence to proceed — the claim is no longer speculative.

The unresolved question is whether federal disability law can override state rent-control limits, at least for newer accessible units.

If accessible newer units are ever pulled under rent control, that hits underwriting, rent-growth assumptions, cash flow projections, and exit pricing for affected owners.

The California Apartment Association warns the implications could spread beyond Oakland to other cities that rely on Costa-Hawkins exemptions for newer housing.

A federal case out of Oakland could test an assumption many California housing owners rely on: that newer apartments are generally exempt from local rent control. In Smith v. City of Oakland, tenants with mobility disabilities argue that Oakland's Rent Adjustment Program effectively excludes them because it mostly covers older units, while many accessible units were built later and fall outside the program.

What the lawsuit argues

The argument hinges on a structural mismatch. Federal accessibility rules pushed newer multifamily housing to include more accessible features. So many of the units most usable for renters with mobility disabilities are also the units least likely to receive Oakland's rent-control protections.

The plaintiffs say this denies them meaningful access to a city benefit that Oakland chose to provide — turning what looks like a neutral age-based exemption into something that disproportionately affects disabled renters.

Why the court is treating it seriously

What makes the case important for real estate is that the court has already treated the claim as serious rather than speculative. In an August 2025 order, the federal court said the tenants had presented enough evidence to support their argument that Oakland's rent-control system may unlawfully disadvantage renters with mobility disabilities.

The court did not order a final remedy. But it made clear that the next big questions are whether Oakland may have to modify its program, and whether federal disability law could override state rent-control limits in this setting.

If accessible newer units are ever pulled under rent control, that could weaken one of the major value drivers of newer exempt housing.

What it means for owners and investors

For owners, the concern is straightforward. The exemption for newer construction is one of the reasons newer Bay Area multifamily trades at a premium to comparable older stock. If a court starts carving exceptions into that exemption — even narrowly, for accessible units — that premium gets harder to underwrite.

Specific places this would land:

Rent-growth assumptions on newer accessible units

Projected cash flow and DSCR on planned acquisitions

Exit pricing assumptions baked into 5- and 10-year holds

Registration, notice, petition, and compliance work for owners and property managers who previously operated outside Oakland's rent-control system

⚠️

 Heads Up

Oakland's rules have not changed, and the court has not issued a final remedy. But if you're underwriting a Bay Area acquisition right now — especially newer construction with accessible units — it's worth stress-testing the deal against a scenario where the exemption is narrower than today's rules suggest.

The bigger picture beyond Oakland

The California Apartment Association warns that a broader ruling could extend beyond Oakland and put pressure on other California cities that rely on Costa-Hawkins exemptions for newer housing.

Developers are watching too. One of the main reasons California has exempted new construction from rent control has been to preserve some incentive to build. If courts begin requiring exceptions to those exemptions, some investors may price in more regulatory uncertainty for new multifamily projects — exactly the opposite of what state housing policy has been trying to achieve.

⚖️

 Legal Note

Nothing in this article is legal advice. Smith v. City of Oakland is unsettled, and the federal court has not yet ruled on a remedy. Before making decisions that depend on a property's exemption status — particularly for newer accessible units — consult an attorney with experience in California rent control and fair housing.

The bottom line

Oakland's rules have not suddenly changed, and the court has not issued a final remedy. But Smith v. City of Oakland is the kind of case that gets watched closely because it could quietly shift how owners, buyers, lenders, and developers think about accessible units, rent-control risk, and the long-term value of "exempt" housing.

The right move for now isn't panic — it's awareness. Know which of your units would be exposed if the exemption gets narrowed, and factor that into how you underwrite the next deal.

 Next Step

Reviewing a Bay Area multifamily acquisition?

Reach out and we'll walk through how this case — and your specific property — could affect underwriting, rent-growth assumptions, and exit pricing.

A Calmer Alternative to Short-Term Rental Chaos

If you’ve ever dealt with short-term rental whiplash—constant messages, frequent turnovers, last-minute cleaning coordination, and unpredictable calendars—mid-term rentals can feel like a more manageable middle ground.

What Is a Mid-Term Rental?

A mid-term rental is typically a furnished property rented for 30 days or more, with many stays lasting anywhere from one to six months. It sits between the two familiar models investors already know: the high-touch pace of short-term rentals and the slower, steadier rhythm of traditional year-long leases. For owners who want more flexibility than a standard lease but less operational chaos than nightly bookings, that middle lane can be appealing. However, before changing rental strategy, it also helps to review my California landlord compliance updates for 2025–2026.

Why Healthcare Professionals Are a Natural Fit

One of the strongest demand sources for mid-term rentals is the healthcare sector. Traveling nurses, traveling therapists, and other medical staff often accept temporary assignments lasting several weeks or a few months. In many cases, those assignments get extended, which can lead to longer occupancy without the frequent turnover that comes with vacation rentals. In markets with major hospitals, clinics, rehabilitation centers, or medical networks, that demand can create a more consistent pool of potential tenants looking for clean, comfortable, move-in-ready housing.

The Practical Benefits for Small Investors

For small investors, the advantages are often practical rather than flashy. A mid-term rental can offer longer stays than nightly rentals, which usually means fewer turnovers, fewer cleanings, and less day-to-day communication. At the same time, monthly pricing can sometimes outperform a standard 12-month lease because tenants are paying for flexibility, furnishings, and included utilities. In other words, you may be able to earn a premium without taking on the full management intensity of a short-term rental business.

Less Management, More Breathing Room

That lower management burden is a major part of the appeal. Instead of constantly adjusting rates, responding to weekend check-ins, and turning the unit over every few days, you may manage only a handful of tenant transitions each year. The experience can feel closer to traditional landlording, but with shorter commitments and a furnished product that meets a specific market need.

A Smart Alternative to Vacation-Rental Dependence

Mid-term rentals can also be a useful option for investors who want to diversify away from pure vacation-rental demand. Not every property is in a tourist-heavy location, but many markets still have employers, hospitals, universities, and temporary workforce activity that support longer furnished stays. That creates a different type of renter profile—one that is often less focused on amenities and entertainment, and more focused on convenience, cleanliness, location, and reliability.

The Costs and Risks to Keep in Mind

Of course, mid-term rentals are not effortless. Furnishing a property well enough to compete can require upfront capital, and including utilities, internet, and household basics adds to the monthly operating cost. Vacancy gaps can still happen, especially in areas without strong year-round demand drivers. If your property is not near a hospital, business center, university, or other employment hub, filling the calendar may take more work than expected.

Why Location Matters More Than Ever

That is why location matters so much. A mid-term rental tends to work best when it solves a clear housing problem for someone on a temporary stay. Properties near hospitals and clinics often stand out because they meet an existing need: safe, comfortable housing for professionals who need flexibility but do not want the hassle of setting up a lease, furnishing a unit, or bouncing between hotels.

The Long-Term Appeal of the Mid-Term Rental Model

For investors willing to furnish thoughtfully, price realistically, and target the right renter, mid-term rentals can offer a compelling balance: more income potential than a standard long-term lease, less friction than a short-term rental, and a business model that can feel much more sustainable over time.

What is a sewer lateral?

A sewer lateral is the underground pipe that carries wastewater from a building to the public sewer main in the street. Most properties have one lateral; some duplexes and small multifamily buildings have shared laterals, which can add complexity (and cost) if repairs are needed.

Who maintains it?

In most Bay Area jurisdictions, the property owner is responsible for the “private” lateral—generally from the building to the connection point at the public main (often including the portion under the sidewalk/street, depending on local rules). The city or sanitation district typically maintains the public main in the street.

Because definitions vary, investors should treat lateral responsibility as jurisdiction-specific until confirmed.

Why it matters in a sale (point-of-sale ordinances):

In cities with a sewer lateral point-of-sale ordinance, the lateral becomes a compliance item—similar to smoke/CO detectors, but often far more expensive and time-sensitive. Common requirements include:

A lateral inspection/test (often by video camera) before close of escrow

Repairs or replacement if defects are found (roots, offsets, collapsed clay pipe, cracks, bellies)

A certificate of compliance issued by the city/district

Permits, licensed contractor requirements, and re-inspections

For investors, the risk isn’t just the bill—it’s timing and leverage. A failed lateral can delay closing, trigger renegotiation, or force a seller credit. For 1031 exchange buyers, delays can also compress already-tight replacement-property timelines. Sale prep also now overlaps with smoking-related disclosure rules in 2026, not just physical repair items.

Investor takeaway (quick due diligence):

Ask early: “Is this property subject to a point-of-sale sewer lateral ordinance?”

Request any past sewer permits, inspections, and certificates

Budget a contingency for older stock and heavy landscaping/tree roots

If shared laterals exist, confirm access rights and cost-sharing agreements

For investors in San Mateo and Santa Clara Counties, this matters for two reasons: (1) Redwood City is often a policy “test case” for other Peninsula jurisdictions, and (2) even the process of a rent control campaign tends to shift the local climate around tenant protections, code enforcement, and operating expectations.

What’s in the Redwood City initiative (high level)

Based on the filed ordinance text and local coverage, the initiative would establish a local rent stabilization framework that limits annual rent increases tied to inflation with a hard cap (reported as 5%), with a pathway for owners to petition for higher increases under certain cost conditions.

It also proposes stronger tenant protections around evictions and displacement, including relocation benefits in certain “no-fault” scenarios and a “right to return” concept tied to renovations. The ordinance text also references relocation assistance that can reach up to four times HUD Fair Market Rent, capped at $12,000.

Just as important: the measure addresses Costa-Hawkins exemptions, indicating that exempt units are excluded from the rent stabilization portions (rent caps), though the text suggests other tenant-protection provisions may still apply depending on how the ordinance is implemented and interpreted.

How does this differ from Redwood City’s current rules?

Redwood City already has tenant protection policies that include a rent cap aligned with AB 1482 (5% + CPI, up to 10%), as well as local rules on just cause, minimum lease terms, and relocation assistance. The initiative is a step beyond that baseline: it would move the city into a more formal rent stabilization regime, with broader administrative oversight and stronger displacement rules. Owners should also review smoking rules landlords can enforce in 2026, especially when updating lease language and house rules.

What should owners do now?

Track qualification status. Today, the official status is “petition in circulation.”

Review your underwriting assumptions. If you own (or are buying) older multifamily, model scenarios with lower rent growth and higher relocation costs. For a broader statewide checklist, review my California landlord compliance updates for 2025–2026.

Expect ripple effects. If Redwood City advances rent control, other Peninsula cities may face renewed pressure to tighten their own tenant protections.

(This article is for general educational information only and is not legal advice.)

(This article is for general educational information only and is not legal advice.)

Tobacco, vaping, and cannabis rules—without the confusion

If you own rentals in the Bay Area, you’ve probably heard some version of: “Cannabis is legal now, so tenants can smoke,” or “You can’t enforce a no-smoking rule.”

In 2026, the practical reality is this: landlords generally can prohibit smoking (tobacco, vaping, and cannabis) on their property, but local ordinances, neighbor complaints, and inconsistent enforcement are where the real risk lives.

Below is a plain-English orientation to the rules and the misconceptions that could get landlords into trouble.

1) Cannabis being legal doesn’t mean tenants have a right to smoke

California legalized adult-use cannabis, but that doesn’t create a tenant “right” to smoke in a rental.

From a landlord risk perspective, cannabis should be treated like tobacco smoke:

It can create odor, residue, and neighbor complaints

It can trigger nuisance allegations (especially in multi-unit properties)

It can lead to disputes over quiet enjoyment and “smoke drift” into other units

Bottom line: the legality of the product does not equal permission to use it in a way that affects the property or other residents.

2) Yes—landlords can typically ban smoking (tobacco, vaping, cannabis)

California law generally allows landlords to adopt smoke-free policies, as long as they’re implemented correctly. A clear no-smoking clause in the lease or written house rules is the foundation.

A practical smoke-free policy often addresses:

Inside the unit

Balconies/patios (common problem area in multi-unit buildings)

Common areas (hallways, courtyards, laundry rooms)

A perimeter rule (e.g., “no smoking within X feet of buildings,” if consistent with local rules)

Also important: vaping/e-cigarettes are treated as “tobacco products” under state law, so they typically fall under the same “no smoking” umbrella.

3) “No statewide right to smoke” — but local rules can be stricter

There’s no California statewide law that guarantees tenants a right to smoke inside a rental unit.

In practice, many Bay Area cities go further than state law—especially for multi-unit buildings. Local ordinances in places like San Bruno, Redwood City, and San José may prohibit smoking in:

Multi-unit units (interiors)

Balconies and patios

Common areas and near building entrances/windows

Why this matters: Even if your lease is vague, the city’s ordinance may still apply. And if you own properties in multiple cities, the rules may differ from one property to the next. For city-specific examples, compare San Bruno’s new tenant protections and Redwood City’s new rent control initiative.

4) Enforcement: the “paperwork” matters more than the argument

Even when you’re clearly allowed to ban smoking, landlords often lose momentum because enforcement is inconsistent or poorly documented.

Typical enforcement (conceptually) looks like other lease violations:

Written notice describing the violation

A chance to cure (stop the behavior)

Escalation if it continues

In “just cause” jurisdictions (common in the Bay Area), ongoing smoking that materially impacts others can also be framed as nuisance behavior, especially when there are repeat complaints, building-wide impacts, or evidence of smoke entering other units.

What usually goes wrong:

The rule wasn’t clearly written into the lease/house rules

The landlord enforced it against one tenant but ignored others

Complaints weren’t logged (dates, times, who complained, what was observed)

The landlord relied on “everyone knows” instead of written proof. For a broader operational checklist that goes beyond smoking issues, review my California landlord compliance updates for 2025–2026

5) Secondhand smoke is a real liability issue in multi-unit housing

The biggest risk isn’t the smoker; it’s the neighboring tenant’s complaint and how it’s handled.

Tenants exposed to drifting smoke sometimes argue:

Nuisance (interferes with the use/enjoyment of their unit)

Quiet enjoyment concerns

In more extreme situations, habitability-type allegations (especially where health issues are involved)

California courts have acknowledged that excessive secondhand smoke can meaningfully interfere with tenancy rights in certain fact patterns. Practically, this means owners should treat repeated smoke complaints like a real operational issue—not “just drama.”

6) Medical cannabis: accommodation requests come up—but smoking isn’t guaranteed

A common misconception: “If it’s medical, you have to allow smoking.”

In practice, accommodation requests are nuanced. But from a risk-education standpoint, what matters is this: landlords are not automatically required to permit smoking as an accommodation. Many owners respond by exploring non-smoking alternatives (edibles, tinctures, patches, etc.) rather than allowing smoke in or around buildings.

This is one of those areas where the “how” matters a lot—especially in multi-unit settings—so it’s a good moment to involve a qualified legal professional if it escalates.

7) The “new 2026 disclosure law” is real—but it’s about SALES, not rentals

This one surprised many owners:

Assembly Bill 455 (2025), effective January 1, 2026, adds a smoking-related disclosure to California’s standard home sale disclosures. In plain terms, home sellers must disclose—if they have actual knowledge of it—either:

Tobacco/nicotine thirdhand smoke residue (the leftover chemical residue/smell), and/or

A history of smoking/vaping on the property

Key point for landlords: this is a sales disclosure requirement, not a statewide rental disclosure requirement.

If you’re selling a 1–4 unit residential property and you know there’s tobacco/nicotine residue or a smoking history, it’s now squarely in the disclosure conversation.

If you’re renting, the focus remains on your lease terms, house rules, and local ordinances, not on a statewide “tell every new tenant about past smoking” rule. At least not yet. If you may sell in the near future, also review sewer laterals and other hidden sale-line items that can delay escrow.

Practical Takeaways for Bay Area Landlords

Without getting into legal instructions, here are smart, high-level ways to reduce risk:

Review your lease language: Is smoking (including vaping and cannabis) addressed clearly, and does it match how you want to operate the property?

Check city rules where your property sits: Multi-unit ordinances can be stricter than state law, especially for balconies/common areas.

Document complaints consistently: Date/time, who complained, what they observed, and what you did next.

Enforce evenly: Selective enforcement is where policies fall apart.

If you plan to sell: Be aware of AB 455’s new thirdhand-smoke disclosure expectations for residential sales starting in 2026. And if tighter rules are making you rethink traditional leasing, consider mid-term rentals as a lower-drama alternative.

Educational Disclaimer

California Landlord Compliance Update for Small Investment Owners (2025–2026): Four Operational Changes to Implement Now

If you own investment property in San Mateo or Santa Clara County, the most expensive “compliance mistake” is usually not a fine - it’s a preventable dispute, a botched turnover file, or a timeline you didn’t account for. Several California laws that took effect in 2025 (and one starting in 2026) change the day-to-day playbook for deposits, documentation, and the timeline for certain tenant disputes. For city-level examples of local rules layering on top of state law, see San Bruno’s new tenant protections and Redwood City’s new rent control initiative.

1) Evictions: Front-End Timelines Are Longer Under AB 2347

What changed: Effective January 1, 2025, AB 2347 generally extends the time for a defendant to respond in unlawful detainer from 5 days to 10 court days, excluding weekends and judicial holidays.

Why this matters to small owners:

Cash drag increases. If rent is unpaid, a longer response window can mean more time before the case advances - especially when you add service issues, continuances, and local court backlogs. (This is particularly painful on a duplex or fourplex where one nonpaying unit is a significant percentage of income.)

Underwriting needs a wider “stress band.” When you buy or refinance, it’s prudent to model a higher reserve for loss-to-lease and legal timeline risk than you might have in future years.

Process errors cost more. When the timeline is longer, mistakes in notice language, service, or documentation can multiply your costs.

Practical steps to implement:

Update your timeline template (notice served → complaint served → response due → next steps) so you and your attorney/Property Manager are working off the same calendar.

Tighten your rent-collection workflow (clear late-fee policy, if permitted; consistent reminders; documented payment plans). The goal is fewer escalations, not “harder” escalations.

On purchases: ask the seller/manager for a list of current disputes, delinquency history, and their standard notice/service process. Treat weak documentation as a pricing issue.

2) Security Deposits: Photo Documentation Is Now Required Under AB 2801

What changed: AB 2801 adds mandatory photo documentation tied to security deposit deductions.

Starting April 1, 2025, landlords must take photographs within a reasonable time after possession is returned and before any repairs/cleaning for which a deduction will be taken, and again after those repairs/cleaning are completed.

For tenancies beginning on or after July 1, 2025, landlords must also take photographs immediately before or at the start of the tenancy (a baseline set). Source

Why this matters to small owners:

Deposit disputes often come down to credibility. A clean photo set is the fastest way to reduce “he said/she said.”

Your process must be consistent. If you take photos “sometimes,” you will inevitably skip it during the turnover when you need it most.

A simple, repeatable Standard Operating Procedure (SOP) (works for 2 units or 20):

Move-in baseline (new tenancies 7/1/25+): 25–40 photos covering every room + floors/walls, appliances, fixtures, windows, patio/yard/garage if applicable.

Move-out (pre-work): photos taken after keys are returned and the unit is empty, before cleaning/repairs are tied to deductions.

Post-work: photos after cleaning/repairs are completed if you are charging for them.

File structure that prevents headaches:

Folder naming: 123 Main St / Unit 2 / 2025-08-01 Move-In

Repeat for Move-Out Pre-Work and Post-Work

Store in one system (Drive, Dropbox, Property Management software). Don’t scatter photos across phones.

On purchases: request the last two years of deposit dispositions and ask, “Do you have move-in and move-out photos for recent turnovers?” Weak files are a red flag for hidden liability and operational sloppiness. That same due diligence mindset matters in escrow, too, especially with sewer laterals and other hidden sale costs.

3) Positive Rent Reporting: AB 2747 Requires an Offer for Covered Landlords

What changed: AB 2747 requires covered landlords to offer tenants the option to have positive (on-time) rent payments reported to at least one credit bureau. Key timing points include:

For leases entered into on or after April 1, 2025, the offer must be made at the time of the lease agreement and at least annually thereafter. Source

For leases outstanding as of January 1, 2025, the offer generally needed to be made no later than April 1, 2025, and at least annually thereafter.

Who is covered (essential for small owners):
Industry guidance commonly summarizes the law as applying to:

Properties with 16+ units, and

15 or fewer units if the property is corporate-owned and the owner owns more than one residential rental property. Source

Many actual mom-and-pop owners (personal ownership, one property, under 16 units) may not be covered—but you should verify based on your ownership structure.

Fees: The bill text and legislative summaries commonly describe an allowed charge as the lesser of $10/month or the actual cost (if the landlord incurs no cost, no fee may be charged).

Why this matters operationally (even if you’re exempt):

Tenants may ask about rent reporting because it’s becoming more common.

Practical steps:

Determine whether you’re covered based on unit count + ownership structure.

If covered, pick a vendor and create a one-page election form and a calendar reminder for the annual re-offer.

4) Appliances: AB 628 Adds a Stove + Refrigerator Requirement Starting January 1, 2026

What changed: California is expanding the definition of “tenantable/habitable” for many rental units. AB 628 requires that, beginning with leases entered into “next year” (starting January 1, 2026), rental units include a working stove and refrigerator to be considered habitable. Source

The Governor’s announcement calls explicitly out AB 628 and the January 2026 timeline.

Important details to know:

The bill language includes a limited pathway for a tenant and landlord to agree at lease signing that the tenant will provide and maintain their own refrigerator, subject to statutory conditions. Source

The bill also addresses recall situations and repair/replacement expectations (commonly summarized as requiring action within a set time after notice).

Why this matters to small owners:

In some Bay Area submarkets, it has been common for tenants to supply a refrigerator. That shifts in 2026 for many leases.

It’s a capital expenditure (Capex) and maintenance issue, not just a lease-wording issue.

Practical steps to take before 1/1/26:

Inventory each unit: “Who owns the fridge? Who owns the stove? Condition? Age? Replace/repair budget?”

Decide your standard: brand tier, delivery/haul-away plan, repair vendor.

Update your lease package with an appliance addendum that matches how you will operate under AB 628 (and consult counsel if you plan to use any tenant-provided refrigerator election). Lease package updates should also stay consistent with smoking rules landlords can enforce in 2026, especially for multi-unit properties.

A 30–60–90 Day Implementation Plan

Next 30 days (no-cost improvements)

Create your turnover photo checklist and folder naming convention (move-in / move-out, pre-work / post-work).

Update your unlawful detainer timeline assumptions in your reserves and your internal “what happens next” flowchart.

Next 60 days (system upgrades)

Confirm whether AB 2747 applies to your portfolio (unit count + ownership structure) and document your approach.

Standardize your deposit return package so it always includes photos when deductions are made.

Next 90 days (2026 readiness)

Complete your appliance inventory and set a 2026 capex reserve line for any unit that will need a landlord-provided fridge/stove.

Bottom line

For small multifamily owners, the win is not “knowing the law”—it’s building a repeatable system that protects cash flow and reduces disputes. If you implement only one thing this month, make it the photo documentation workflow. It’s low effort, high payoff, and it strengthens your position in almost every tenant-facing conflict that starts with, “That wasn’t like that when I moved in.”

If you own rental property in San Bruno, you’ve probably heard bits and pieces about “new tenant protections” coming soon…but it may not be clear what’s actually changing or how it could affect you.

If you own rental property in San Bruno, you’ve probably heard bits and pieces about “new tenant protections” coming soon…but it may not be clear what’s actually changing or how it could affect you.

San Bruno’s 2023–2031 Housing Element includes Program 18 – Tenant Protections & Anti-Displacement Initiatives. In plain English, the City will consider adding several new rules, including:

A local just-cause eviction ordinance that goes beyond current state law

A tenant/community “first right to purchase” for some multi-unit buildings.

An anti-displacement plan focused on neighborhoods east of El Camino Real.

Key parts of this package are expected to be adopted by the end of 2025, with most rules likely taking effect in early 2026.

Let’s break down what that means if you’re a San Bruno landlord.

1. Local Just-Cause Eviction: Stricter Rules Than State Law

Right now, California’s state law (AB 1482) requires “just cause” for many evictions after a tenant has been in place for 12 months, with several exemptions.

San Bruno’s proposed local ordinance is expected to:

Require a valid, specific reason to end a tenancy (nonpayment, serious lease violations, owner move-in, etc.)

Cover more units than state law, potentially including some newer buildings or smaller properties.

Lower or eliminate the 12-month threshold, meaning protections could apply much earlier in the tenancy

Require relocation payments (at least around 3 months’ rent) when a tenant is asked to move for “no-fault” reasons, such as owner move-in or major rehab

These protections are expected to be permanent (no sunset date) unless the City repeals them in the future.

What this means for you:

You’ll still be able to evict for legitimate reasons, but “no reason” or “I just want the unit back” will likely come with clear rules and costs.

Planning to move back into your own rental or do a major remodel? You may need to budget for relocation assistance and follow specific notice requirements. For a practical rules-and-systems checklist beyond San Bruno, review my California landlord compliance updates for 2025–2026

This is not rent control, but it is a meaningful change in how you manage tenancies and transitions. For another Peninsula example of local regulation shaping owner decisions, see Redwood City’s new rent control initiative.

2. Anti-Displacement Focus East of El Camino Real

Program 18 also calls for a detailed anti-displacement plan for neighborhoods east of El Camino Real—areas the City considers more vulnerable to rising rents and redevelopment pressure.

The plan (expected by 2027–2028) will likely include:

Data on which households and properties are most at risk

Targeted tools such as rehab grants, rent assistance, or incentives to preserve affordability

Stronger rules around converting rentals, “no net loss” requirements, and possibly special zones where displacement risk is high.

If your property is east of El Camino Real:

You may see more attention and oversight if you plan to redevelop or convert rentals.

There may also be new programs or financial incentives to maintain or improve your units while keeping them affordable.

3. First Right to Purchase & Condo Conversion Rules

Another piece of the puzzle is a tenant/community “first right of purchase” policy (TOPA/COPA) for some multi-unit buildings. That means when certain rental properties go up for sale, tenants or qualified non-profits may get a first chance to buy before the property is offered more broadly.

The City also plans to tighten condo conversion rules, including a requirement to replace any lost rental units one-for-one, aimed at preventing a net loss of rental units.

Why this matters if you might sell:

The sales process could become more procedural, especially for small apartment buildings.

You may need extra lead time and a clear plan for navigating any first-right-of-purchase steps.

Serious investors will want to understand these rules before making offers—so having an agent who already follows this closely is a real advantage.

4. So…Does This Mean You Should Sell?

Not necessarily.

Some landlords will decide to hold long-term, update their systems, and treat these protections as the “new normal” in the Bay Area. Others—especially smaller, mom-and-pop owners—may feel that added regulation, potential relocation costs, and future policy changes tip the scale toward doing a planned exit in the next few years.

Here are a few good questions to ask yourself:

Do I still want to be an active landlord under stricter local rules?

Am I prepared—financially and emotionally—for relocation payments and more formal processes if I ever need a tenant to move?

Would a sale or 1031 exchange into something simpler and more passive make more sense for this stage of my life? If you are not ready to sell but want a lower-friction hold strategy, consider mid-term rentals as a lower-drama alternative.

Let’s Talk About Your Property

I follow San Bruno’s Housing Element and City Council meetings so you don’t have to. I’m not an attorney or tax advisor, but as a local Realtor who works with small landlords, I can:

Walk you through how these changes might affect your specific property

Help you understand the current market value and buyer demand

Explore options—hold, remodel, sell, or exchange—based on your goals and timeline

If you own rental property in San Bruno and you’re even thinking about selling in the next 1–5 years, now is the perfect time to get a plan in place.

Fill out the form below, call or text me at 650-339-1944, or email jzazuetaRE@gmail.com for a free, no-pressure “Policy & Price Check” for your San Bruno property.
